Time for another roundup of visa updates… And, well, not much has changed yet again. This post will be short and sweet, as I doubt there’s anything that warrants its own lengthy write-up.

People are still waiting for the visa bulletin update to come out on October 1st, but let’s face it, chances are slim it’ll happen anytime soon… And any changes if they do come out will be a result of the Nepal earthquakes rather than anything else.

People who have been waiting for their priority dates to become current in order to file their I-485’s… Your wait is almost over! The October Visa Bulletin came out on Monday, October 5th and what it means for most applicants is that if their priority date falls somewhere between June 1st and August 26th, they can file their I-485’s. Once it becomes December, you’ll be able to file for adjustment of status (AOS)…

If your priority date falls within this range but is not current yet (meaning that the final action date for your priority date is before the cut off date), you can apply for a work permit and EAD.

If you’re outside of this range, no worries… Your priority date will become current sooner than you think. It’s also important to note that the visa bulletin is not affecting EB3 dates in this range, so if your priority date falls in June or later (August 26th), it will most likely not become current.

As for other cases, including EB2-NIW and EB1/EB2 ROW dates, they’re all still waiting in line… No movement whatsoever. If this continues, it might be a good idea to look into filing an I-140 NIW petition because you will probably not want to kill two birds with one stone and file an I-485 in the far off future when your priority date becomes current.
